The Site is owned and operated by SimonMed Imaging (“SimonMed,” “we,” “us,” or “our”).
By accessing, browsing, or using the Site, or by clicking to accept or agree where this option is made available, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree, do not use the Site.

1. Purpose of the Website


The Site is provided for informational, educational, scheduling, administrative, and patient service purposes only. Content made available on the Site is not intended to replace professional medical advice, diagnosis, or treatment.

Appointment requests are not final until confirmed by SimonMed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMONMED SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE.

12. Arbitration Agreement and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration, except that either party may bring claims in small claims court if eligible.
Arbitration shall be conducted on an individual basis.
You and SimonMed waive the right to participate in a class action, class arbitration, or representative proceeding.
The arbitration shall be governed by the Federal Arbitration Act.
This section does not apply where prohibited by law.

13. Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles, except where superseded by federal law.
To the extent any dispute is not subject to arbitration, such dispute shall be brought exclusively in the state or federal courts located in Arizona.

SimonMed reserves the right to modify these Terms of Use at any time. Updates will be posted on this page with a revised effective date. Continued use of the Site after changes constitutes acceptance of the updated Terms.
