This Cookie & Communications Consent Policy explains how we use cookies and similar technologies and how you may provide consent to receive communications from SimonMed.

This Policy describes SimonMed’s use of cookies and similar technologies, explains how consent is obtained and managed for website functionality, analytics, and marketing, and outlines how individuals may consent to receive electronic communications in compliance with applicable privacy and communications laws.

Where required by law, SimonMed will obtain your affirmative consent prior to engaging in marketing communications.

a. Marketing Communications via Email (CAN-SPAM)

By submitting your email address and affirmatively opting in, you consent to receive marketing and promotional email communications from SimonMed, which may include educational information, service announcements, promotions, and special offers.

All marketing emails:

  • Clearly identify SimonMed Imaging as the sender
  • Include a valid physical mailing address
  • Contain a clear, conspicuous, and functioning unsubscribe mechanism

You may opt out of marketing emails at any time by using the unsubscribe link included in each message. Opt-out requests are honored in accordance with CAN-SPAM requirements.

b. Marketing Communications via Text (SMS/MMS) (TCPA)

By providing your mobile phone number and affirmatively opting in, you expressly consent to receive marketing text messages from SimonMed, which may be sent using automated technology where permitted by law.

You may opt out at any time by replying STOP to any marketing text message. A confirmation message may be sent following opt-out.

Consent to receive marketing text messages is not a condition of receiving medical care or services.

By providing your email address and/or mobile phone number, you authorize SimonMed to communicate with you regarding healthcare-related and administrative matters, including but not limited to:

  • Appointment confirmations, reminders, and scheduling updates
  • Exam preparation instructions and care coordination
  • Post-exam follow-up communications
  • Billing, payment, and insurance-related notices
  • Patient satisfaction or quality-of-care surveys

These communications are considered transactional, operational, or treatment-related and are not marketing communications under HIPAA, CAN-SPAM, or TCPA. Such communications may be sent regardless of marketing opt-out preferences.

You acknowledge that email and text messaging may not be fully secure. By providing consent, you authorize SimonMed to communicate with you electronically despite the potential risk of unauthorized access.


5. Personal Information Collected Through This Site


There may be instances where SimonMed collects personally identifiable information through this Site, including, without limitation, your name, mailing address, phone number, email address, primary health insurance information, and payment-related information.

SimonMed may use this information to:

  • Confirm your registration or appointment
  • Fulfill requests for promotional items or information
  • Fulfill requests for physician or service referrals
  • Respond to customer service inquiries
  • Keep you informed about services, events, or other information that may be of interest
  • Fulfill other purposes permitted by this Policy and applicable law

SimonMed does not request medical information through non-secure website forms and asks that you not submit medical information outside of authorized secure patient portals or intake systems.


6. Disclosure of Personally Identifiable Information

SimonMed does not sell personally identifiable information. In general, SimonMed will not disclose information that identifies or could reasonably be used to identify you personally (such as name, address, date of birth, telephone number, email address, Social Security number, or health plan beneficiary numbers) without your consent, except where required or permitted by law.

SimonMed may disclose limited contact information, such as name, mailing address, and/or email address, to trusted third-party vendors or partners acting on SimonMed’s behalf solely for marketing, analytics, communications, or other purposes permitted under this Policy, subject to contractual confidentiality and data protection obligations.


7. Analytics, Remarketing, and Third-Party Technologies


When you use our websites or applications, SimonMed may collect certain information by automated means using third-party analytics and remarketing services such as Google Analytics and advertising platforms. These technologies use cookies to collect information that may be used to serve advertisements across the internet and to help improve website performance and user experience.

Information collected may be matched or merged with aggregated market or demographic data for marketing and research purposes. These data sets and segments do not personally identify individuals. The protection of protected health information (PHI) is governed by SimonMed’s Notice of Privacy Practices.

You may manage or withdraw your consent at any time by:

  • Adjusting cookie preferences through our website
  • Using the unsubscribe link in marketing emails
  • Replying STOP to marketing text messages
  • Updating communication preferences through patient portals, intake forms, or account settings
  • Contacting SimonMed directly

Withdrawal of consent does not affect the lawfulness of processing or communications made prior to withdrawal.

The following sample language may be used where consent is collected on SimonMed digital properties:
a. Patient Portals, Online Registration, and Intake Forms
“By providing your email address and/or mobile phone number, you consent to receive appointment reminders, care-related communications, and administrative notifications from SimonMed Imaging via email and text message. You understand that these communications may include protected health information and that electronic communications may not be fully secure.”
b. Marketing and Lead Generation Pages
“By submitting this form, you agree to receive marketing emails and/or text messages from SimonMed Imaging. Consent is not a condition of receiving medical services. Message and data rates may apply. You may unsubscribe from emails at any time or reply STOP to opt out of text messages.”
c. Cookie Banner Short-Form Notice
“We use cookies to operate our site, analyze usage, and support marketing. By selecting ‘Accept,’ you consent to the use of non-essential cookies. You may manage your preferences at any time.”
